The proposed online platform would facilitate the trading and supply of data-related products and services in a manner that is both appropriate and legal. According to the ministry, the platform would be officially approved and overseen by the ministry itself, ensuring compliance with all relevant laws and regulations.
State-owned enterprises and public non-business units under state management would be permitted to establish these data exchange platforms. These entities would be required to submit regular reports on their activities to authorities.
The draft law stipulates that only non-personal data or personal data with explicit consent from the data owners can be traded on the platform. It also emphasizes that the data exchanged must not compromise national security, defense, state secrets, public interests, or the legitimate rights of individuals and organizations.
The operational framework of the platform would be transparent, outlining the responsibilities of all involved parties. It would also include measures to ensure information privacy, address complaints and resolve conflicts.
The ministry stated that the draft law is part of a broader effort to develop a network of data exchange platforms in line with the national data strategy. This network aims to enhance connectivity and foster business growth within the data industry while supporting solutions for data security and privacy.
To support these goals, the government plans to establish clear regulations on data ownership and sale, thereby recognizing data as a legally protected asset.
As per the national data strategy issued by the prime minister, Vietnam plans to pilot five data exchange platforms by 2030. The draft Law on Data is scheduled to be presented to the National Assembly next month.
